1. TowGo Respects Copyright

TowGo Marketplace LLC ("TowGo") respects the intellectual property of others and asks users to do the same. If you believe your copyrighted work has been posted on the Platform without your permission, you can send us a takedown notice under the Digital Millennium Copyright Act (DMCA) and we will act on it.

If you receive a takedown notice about your content and you believe it was sent in error, you can send us a counter-notice.

2. Designated Agent

Send DMCA notices to our designated agent:

We also register our designated agent with the U.S. Copyright Office as required under 17 U.S.C. §512(c)(2).

3. How to Send a Takedown Notice

For your notice to be effective under the DMCA, it must include all of the following:

  1. Your physical or electronic signature.
  2. Identification of the copyrighted work you claim was infringed (or a representative list, if there are many).
  3. Identification of the material you say is infringing, with enough detail for us to find it. Include URLs or screenshots.
  4. Your contact information — full name, mailing address, phone, and email.
  5. A statement, made in good faith, that you believe the use of the material is not authorized by the copyright owner, its agent, or the law.
  6. A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on their behalf.

Incomplete notices may not be actionable. When in doubt, include more information than you think you need.

4. What We Do When We Receive a Notice

When we receive a valid DMCA notice, we will:

  • Remove or disable access to the material.
  • Tell the user who posted it that we removed it and why.
  • Give the user a copy of the notice (with your contact info) so they can respond.

We may also warn or suspend accounts that repeat this behavior.

5. Sending a Counter-Notice

If your content was removed and you believe the notice was wrong, you can send a counter-notice. The counter-notice must include:

  1. Your physical or electronic signature.
  2. Identification of the material that was removed and where it appeared before removal.
  3. A statement, under penalty of perjury, that you have a good-faith belief the material was removed by mistake or misidentification.
  4. Your full name, mailing address, and phone number.
  5. A statement that you consent to the jurisdiction of the federal district court where you live (or, if you live outside the U.S., where TowGo is located) and that you will accept service of process from the original complainant.

Send the counter-notice to [email protected] with "DMCA Counter-Notice" in the subject line.

If we receive a valid counter-notice, we will forward it to the original complainant. Unless the complainant files a lawsuit within 10 to 14 business days, we may restore the material.

6. Repeat Infringers

We terminate the accounts of users who repeatedly post infringing content, in accordance with 17 U.S.C. §512(i).

7. False Claims

Making a false claim in a DMCA notice or counter-notice can result in civil liability, including damages and attorneys' fees under 17 U.S.C. §512(f). Please consult a lawyer if you are unsure.
