These Terms of Service (“Terms”) are a binding agreement between you and TowGo (“TowGo,” “we,” “us,” or “our”). They govern your access to and use of the TowGo mobile applications, websites, and related services (together, the “Service”).
Please read them carefully. They include an arbitration clause and class-action waiver that affect how disputes are resolved.
1. Acceptance of these Terms
By creating an account, checking a box indicating your agreement, or otherwise accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy and Refund & Cancellation Policy, which are incorporated here by reference. If you do not agree, do not use the Service.
2. The TowGo Service
TowGo operates an online marketplace and dispatch platform that connects vehicle owners and drivers (“Customers”) who need towing or roadside assistance with independent, third-party tow operators and their drivers (“Operators”). Through the Service you can request assistance, be matched with an available Operator, track the assigned driver, communicate in-app, and pay for completed work.
The Service is provided to help you find and arrange for towing and roadside services. The actual towing, recovery, jump-start, lockout, fuel-delivery, tire-change, and related physical services are performed solely by independent Operators, not by TowGo.
3. Our Role — Marketplace Disclaimer
TowGo is a technology platform, not a towing company. We do not own or operate tow trucks, employ tow drivers, or perform towing or roadside services. Operators are independent contractors and independent businesses that are solely responsible for the services they provide.
TowGo does not direct or control the manner or means by which Operators perform services and makes no representation or warranty regarding the quality, safety, timing, legality, or suitability of any Operator or the services they provide. Any dispute regarding the service performed is primarily between you and the Operator, though we offer the dispute and refund process described in our Refund & Cancellation Policy.
4. Eligibility & Your Account
- You must be at least 18 years old and able to form a binding contract to use the Service.
- You agree to provide accurate, current, and complete information when you register and to keep it up to date.
- You are responsible for safeguarding your login credentials and for all activity that occurs under your account.
- Notify us promptly at [email protected] if you suspect unauthorized use of your account.
5. Your Obligations
- Provide accurate location, vehicle, and contact information so an Operator can safely reach and assist you.
- Be present (or arrange for an authorized person to be present) and reachable when an Operator is dispatched.
- Only request service for vehicles you own or are otherwise authorized to have towed or serviced.
- Treat Operators and their drivers professionally and lawfully.
- Pay all applicable fees for services you request and receive.
6. Prohibited Uses
You agree that you will not:
- Use the Service for any unlawful, fraudulent, or unauthorized purpose, including requesting the tow of a vehicle you have no right to move;
- Harass, threaten, defame, or discriminate against any Operator, driver, Customer, or TowGo personnel;
- Circumvent, disable, or interfere with security or dispatch features, or attempt to access accounts or data that are not yours;
- Scrape, reverse-engineer, or copy the Service, or use bots or automated means to access it;
- Post false, misleading, or harmful content, or upload malware;
- Arrange payment off-platform to avoid fees, or otherwise misuse promotions, disputes, or refunds.
7. Payments, Fees & Cancellations
When you request and receive service, you authorize TowGo and its payment processor to charge your selected payment method for the quoted or metered fare, plus any applicable taxes, tolls, surcharges, or platform fees. Fares may be estimated in advance and finalized on completion based on the actual service performed.
Payments are processed by our third-party payment processor (Stripe). Cancellations, refunds, non-refundable charges, and chargebacks are governed by our Refund & Cancellation Policy.
8. Independent Operators & Third-Party Services
Operators set their own availability and perform services using their own equipment, insurance, and licenses. Your engagement of an Operator creates a direct service relationship between you and that Operator. The Service also relies on third-party services (such as mapping, messaging, and payment providers) that are subject to their own terms.
9. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. TowGo does not warrant that the Service will be uninterrupted, timely, secure, or error-free, or that any Operator will be available, on time, or perform to your satisfaction. You use the Service and engage Operators at your own risk.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TowGo and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or vehicle or property damage, arising out of or relating to the Service or the acts or omissions of any Operator.
To the extent TowGo is found liable, its total aggregate liability for any claim arising out of or relating to the Service will not exceed the greater of (a) the total amounts you paid to TowGo in the six (6) months before the event giving rise to the claim, or (b) one hundred U.S. dollars ($100). Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
11. Indemnification
You agree to indemnify, defend, and hold harmless TowGo and its officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Service, your violation of these Terms, your violation of any law or the rights of any third party, or any service you request from an Operator.
12. Dispute Resolution & Arbitration
Please read this section carefully — it affects your legal rights. Except for small-claims matters and requests for injunctive relief, you and TowGo agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration administered under the rules of a recognized arbitration provider, rather than in court.
Class-action waiver. You and TowGo agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding.
The arbitration will take place in Michigan (or another mutually agreed location or by videoconference), and the arbitrator’s decision will be final and binding. If any part of this section is found unenforceable, the remainder will continue to apply.
13. Governing Law
These Terms and any dispute arising out of or relating to them or the Service are governed by the laws of the State of Michigan, without regard to its conflict-of-laws rules. Subject to the arbitration section above, the state and federal courts located in Michigan will have exclusive jurisdiction, and you consent to venue there.
14. Termination
You may stop using the Service and close your account at any time. We may suspend or terminate your access if you violate these Terms, create risk or possible legal exposure for TowGo or others, or if we discontinue the Service. Sections that by their nature should survive termination (including payment obligations, disclaimers, limitation of liability, indemnification, and dispute resolution) will survive.
15. Changes to these Terms
We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date above and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect means you accept the updated Terms.
